1. Provider and scope

abtakt is provided by Vladimir Viro, Augsburg, Germany (contact: Imprint). These terms apply to the abtakt app and its server services. By using the app you agree to them.

2. Beta, free, with monthly limits

abtakt is a beta version and free of charge. To keep the service working for everyone, limits apply, currently per installation and calendar month 8 uploaded rehearsal recordings and 60 score files; a recording may be up to 1 GB, a score file up to 200 MB. We may change features and limits or end the beta. Before shutting it down we will tell you in the app in good time so you can save your data.

3. No warranty

Rehearsal notes are partly generated automatically and may be incomplete or wrong – for example a remark at the wrong bar or an inaccurate pronunciation. The beta is provided without any commitment to availability or quality. Keep your own copies of important recordings and scores.

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act. Otherwise, our liability for this free service is excluded to the extent permitted by law.

4. Your content

Recordings, scores and other files you upload remain your content. You allow us to store and process them and to show them to you (and to the members of a choir space you share them with) – only in order to provide abtakt to you. This permission ends when you delete the content.

We do not use your uploads to train AI models, for a catalogue or for any other purpose.

5. Rights to uploaded content

Before your first upload you confirm in the app:

"I confirm that I hold the necessary rights to the content I upload and share, or that its use is permitted under the copyright law that applies to me. I am responsible for compliance."

Publishers' editions usually need the publisher's permission, even for old composers. Do not upload content you are not allowed to use.

6. Recordings of other people

If you record a rehearsal, inform the choir beforehand and obtain the members' consent. Do not record if someone objects. See the Privacy Policy for details.

7. Choir spaces and invite codes

An invite code opens a choir space. Share it only with members of the choir and do not publish it. Content in a choir space is meant only for that choir's rehearsal work.

8. Illegal content, notices and blocking

Do not upload illegal content. Anyone who believes that content infringes their rights or is illegal can report it by e-mail to meldung@abtakt.com or, where available, with the app's report function (notice mechanism under Art. 16 DSA). A notice should state which content is affected, why it is illegal, the name and e-mail address of the person reporting, and a statement that the information is accurate to the best of their knowledge. We review notices promptly, block or remove content where the notice is justified, and inform those involved of our decision and the reasons. Users who repeatedly upload manifestly illegal content may be blocked.

9. Ending use and deletion

You can stop using abtakt at any time. "Delete my data" in the app deletes all your uploads and memberships on our server.

10. Changes to these terms

If we change these terms materially, we will point this out in the app and ask for the confirmation in section 5 again where needed.

11. Law

German law applies. If you are a consumer, the mandatory consumer protection rules of your country of residence remain unaffected. We do not take part in dispute resolution proceedings before a consumer arbitration board.
