Terms of Use

1. Provider and scope

ab|takt is provided by Peachnote GmbH, Germany (contact: Imprint). These terms apply to the ab|takt app, the web app and its server services. By using the app you agree to them. ab|takt is for adults: only people aged 18 or over may use the app and the web app. You can use the example and record on your device without an account; to transfer recordings and scores you need an account (section 12).

2. Free, with monthly limits

ab|takt is free of charge. To keep the service working for everyone, limits apply, currently per account and calendar month 8 uploaded rehearsal recordings and 60 score files, together for all devices where you are signed in to the account; a recording may be up to 6 GB, a score file up to 200 MB. We may change features and limits or discontinue the service. Before shutting it down we will tell you in the app in good time so you can save your data.

3. No warranty

Rehearsal notes are partly generated automatically and may be incomplete or wrong – for example a remark at the wrong bar or an inaccurate pronunciation. Analysing an upload takes up to a few hours. The service is provided without any commitment to availability, processing time or quality. Keep your own copies of important recordings and scores.

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act. Otherwise, our liability for this free service is excluded to the extent permitted by law.

4. Your content

Recordings, scores and other files you upload remain your content. You allow us to store and process them and to show them to you in order to provide ab|takt to you. Only you see the results of your uploads, on every device where you are signed in to your account; other users do not see your uploads – except the parts you share with your choir yourself (section 13); for that, you allow us to provide these parts to the members of your choir. Recordings are transferred and processed only if you are signed in and chose "Transfer rehearsals to your score automatically" or tapped "Transfer to score"; you can change that choice under Settings → Transfer rehearsals. This permission ends when you delete the content.

Without your separate consent (Privacy Policy 2 m) we do not use your uploads to train AI models, for a catalogue or for any other purpose. This consent ("Rehearsals for development") is optional, off by default and can be withdrawn at any time. If you give it, section 4a also applies.

4a. Rehearsals for development (optional)

If you choose "Rehearsals for development", you give us a simple, non-transferable, royalty-free right of use to the recordings of the rehearsals you send afterwards, to the bars and parts recognised from the scores and to the results: we may store, reproduce, listen to and analyse them to improve ab|takt and develop new features, including to train our own recognition models with them. The right applies until you withdraw, for a single rehearsal until you exclude it, and at most 3 years after the rehearsal concerned. Score images are excluded. We then delete the kept copies; we may keep using models already trained. You confirm that you may give this right, also with regard to the rights of the singers and the conductor in their performances and the rights in the works rehearsed (section 5). We keep a rehearsal only if the conductor has confirmed for this choir that all singers are informed, agree and are 18 or over (Privacy Policy, section 4).

5. Rights to uploaded content

Before you add your first scores, you confirm in the app:

"I may use the scores I add – ones I wrote myself, public-domain editions, or editions I have the publisher’s permission for. I am responsible for this."

Publishers' editions usually need the publisher's permission, even for old composers. Before you first share with your choir, the app points out that shared rehearsals contain the score pages. Do not upload content you are not allowed to use.

6. Recordings of other people

If you record a rehearsal, inform the choir beforehand and obtain the members' consent. Do not record if someone objects. Rehearsals with minors must not be recorded or uploaded. See the Privacy Policy for details.

7. Choir spaces and invite codes

An invite code opens a choir space. We, the operator, set up choir spaces (choirs you create yourselves are covered by section 13) and provide their content; everyone who has entered the code sees it. Members cannot post anything there themselves, can report content and can leave the space at any time. Share the code only with members of the choir and do not publish it. Content in a choir space is meant only for that choir's rehearsal work.

8. Illegal content, notices and blocking

Do not upload illegal content. Anyone who believes that content infringes their rights or is illegal can report it by e-mail to meldung@abtakt.com or, where available, with the app's report function (notice mechanism under Art. 16 DSA). A notice should state which content is affected, why it is illegal, the name and e-mail address of the person reporting, and a statement that the information is accurate to the best of their knowledge. We review notices promptly, block or remove content where the notice is justified, and inform those involved of our decision and the reasons. Users who repeatedly upload or share manifestly illegal content may be blocked; we may then block or delete an account.

9. Ending use and deletion

You can stop using ab|takt at any time. You can delete prepared scores one by one in the app. "Delete all my data" under Settings → Data on our servers deletes all uploads of that device or browser and its choir space memberships on our server, together with everything you shared with a choir from them; "Export" there gives you a copy of your data first. What is only on your device or in your browser you delete under Settings → Data on this device. "Delete account" under Settings → Account deletes your account with its choir memberships and your sign-in on all devices; your uploads belong to the installation you transferred them from, stay, and can then be seen only there. "Delete all my data" keeps an account. If you are the last conductor of a choir, deleting your account also deletes the choir with all shared content.

10. Changes to these terms

If we change these terms materially, we will point this out in the app and ask for the confirmation on scores (section 5) again where needed.

11. Law

German law applies. If you are a consumer, the mandatory consumer protection rules of your country of residence remain unaffected. We do not take part in dispute resolution proceedings before a consumer arbitration board.

12. Account

An account – and with it transferring, choirs and sharing with the choir – is only for people aged 18 and over. You need an account to transfer recordings and scores; the example and recording on your device work without one. You currently sign in with a code by email; if the app offers other ways (such as Sign in with Apple), these terms apply to them too. When you first sign in, you accept these terms in the version then in force; we store which version that was with your account. The data we process for it is described in the Privacy Policy (section 2 d and e). Recordings, scores and results still belong to the installation you transferred them from, not the account; with the account you see them on every device where you are signed in, and the account counts the monthly limits (section 2).

• Your account is personal; do not pass on codes. Keep access to your mailbox and your Apple ID safe.
• You can delete your account in the app at any time (section 9) or sign out on a device.

13. Choirs and sharing with the choir

With an account you can create a choir and become its conductor, or join a choir with an invite link or code. The conductor invites, removes members, makes members conductors and can delete the choir; members can leave the choir at any time.

• Display name: choose a name by which your choir recognises you, and none that misleads or insults others.
• Invites: pass invite links and codes only to members of your choir and do not publish them. Revoke an invite if it got into the wrong hands.
• Only share what you may share: as a conductor you share selected remarks of a rehearsal with your choir: the wording of the remarks, your audio excerpts, the sung passages and the score pages. Only share recordings and scores you are entitled to share. The sung passages contain the choir members' singing: you are responsible for the choir agreeing that these excerpts are shared with it (see Privacy Policy, section 4). Check the preview before sharing. Shared rehearsals contain the score pages: the confirmation on scores (section 5) also covers sharing, and the publisher's permission must also cover the members' copies.
• No illegal content: do not share anything illegal, offensive or personal that is not meant for the choir.
• For rehearsal work only: what is shared with a choir may be used only by its members and conductors, and only for that choir's rehearsal work. Do not pass it on, do not download it to distribute it, and do not publish it.
• Reporting: you can report shared content in the app or to meldung@abtakt.com (section 8). We review reports and may remove shared content, revoke invites and block or delete accounts if these terms or the law are breached; we inform those involved of our decision and the reasons.
• End: if the conductor stops sharing, you leave the choir or you are removed, your access ends at once. If the underlying rehearsal or the choir is deleted, the shared content is deleted.

13a. Practice tracks

As a conductor you can upload or record practice tracks and share them with your choir. Only share recordings you may share with your choir; you confirm this before your first track. For old works (composer and arranger dead for over 70 years) singing them yourself is usually fine. For protected works or arrangements, ask the publisher if unsure. You usually may not pass on bought practice recordings. As a member you may listen to shared tracks only to practise for this choir. Don't record them or pass them on. Otherwise the same applies as for other shared content (section 13).
